Summary

The Congressional Research Service’s plain-language summary of what the law does.

Prohibits commerce in contraband cigarettes.

Defines "contraband cigarettes" as a quantity of more than 60,000 cigarettes, bearing no evidence of payment of applicable State cigarette taxes, which are in the possession of any person other than: (1) a person licensed by the State where the cigarettes are found or by the Internal Revenue Service; (2) a common or contract carrier; or (3) a government agent in the performance of duties.

Requires dealers in cigarettes in excess of 60,000 in a single transaction to keep records of the purchaser's name, address, destination, purpose of purchase, and name and address of principal, if any.

Provides penalties for whoever knowingly violates this Act. Includes trafficking in contraband cigarettes in the definition of "racketeering activity."

Data notes

The House’s recorded vote on the final version of the law (roll call 1527 in Voteview), matched to the vote the record cites and checked against its totals. Positions are each member’s DW-NOMINATE score for that Congress, as on the Ideology page; left to right is more liberal to more conservative. Paired and announced yea votes count as yea. Lists follow the compass, most liberal first. A name links to a profile only for members of the current Congress. A law passed by voice vote or unanimous consent has no member list, and neither does a vote Voteview has not yet recorded.
